Event Policies

  1. The event is the Sanitarium Weet-Bix™ Kids TRY CHALLENGE (Event).
  2. Participation in the Event is deemed acceptance of these Terms and Conditions.
  3. The promoter of the Event is New Zealand Health Association Limited trading as Sanitarium Health Food Company of 124 Pah Road, Royal Oak, Auckland, New Zealand, 1023 (Promoter). Phone number: 0800 100 257.
  4. Entry is restricted to Greater Auckland/Bay of Islands/Rotorua/ New Plymouth/Gisborne residents only. Participation entries with an address outside these regions will not be accepted.

Entries close on 31 May 2022.

  1. The Event runs from Monday 1 November 2021 until Thursday 30 June 2022.
  2. Entry Options:
  • All participants must register to participate in the Event and to be able to access the programme benefits.
  • Entry is free but there is the option to purchase a “TRY Challenge T-shirt & Medal Pack”. Please see details below:

Option 1 – Free Entry 

The “Free Entry” includes:

  • Downloadable certificate;

Option 2 – TRY CHALLENGE T-Shirt & Medal Pack 

The “TRY Challenge T-Shirt & Medal Pack” includes:

  • Weet-Bix Kids TRYathlon 21/22 Series T-Shirt;
  • Weet-Bix Kids TRYathlon Champions Medal;
  • Downloadable certificate;
  • Chance to WIN spot prizes; and
  • Access to online resources

The “TRY CHALLENGE t-shirt & medal Pack” is $10 plus packing & courier per individual.

  1. In consideration of allowing my child (Child) to participate in the Event, I acknowledge that on my own behalf and on behalf of the Child participating in the Event that my Child will participate in the Event on these terms and conditions. If I do not consent to these terms and conditions, I will not enter, or register my Child for any Event.
  2. I represent, warrant, acknowledge and accept:
  • I am a parent or legal guardian of my Child have the authority to bind myself and my Child to the terms and conditions set out in this document;
  • my Child will be between the ages of 5 and 15 years (as at the date of the relevant Event);
  • participants must have parental/guardian approval to enter the Event, and further, the parent/guardian or teacher of the entrant must read and consent to these Terms and Conditions;
  • parent/guardian or teacher of the entrant must provide safety precautions and adequate supervision of the participant in participating in the Event;
  • parent/guardian or teacher acknowledges and accepts that the Promoter shall not be held liable for any injuries suffered by the participant in participating the Event. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor participating in the Event;
  • I freely and voluntarily assume all risks associated with my Child participating in the Event and acknowledge that my Child’s participation is entirely at their, and my, own risk and that I may withdraw my Child from the Event at any time;
  • my Child is physically and medically fit to participate in the Event. I am not aware of any condition, impairment, disease, illness or other reason why my Child should not participate in the Event; and
  • in participating in the Event I agree that my Child and I will act responsibly and adhere to all New Zealand laws including COVID-19 rules and restrictions (where applicable).
  1. To the fullest extent permitted by law, I indemnify and will keep indemnified the Promoter and each of their directors, officers, employees, volunteers, promoters, independent contractors and agents (Sanitarium Parties) against all costs, losses or damages however caused, arising from or in relation to my Child’s participation in the Event.
  2. To the fullest extent permitted by law, the Sanitarium Parties exclude all liability (including in relation to any warranty or guarantee) arising from any loss or damage suffered by me or my Child in connection with the Event.
  3. To the fullest extent permitted by law, the Sanitarium Parties’ liability to me and my Child for a breach of any non-excludable guarantee is limited to a refund for any registration fees paid to the Promoter in connection with my Child’s entry into the Event.
  4. Nothing in this terms and conditions exclude, limit or modify the application of the New Zealand Consumer Law or any other applicable laws, or the exercise of any rights or remedies conferred by the New Zealand Consumer Law or other applicable laws where to do so would contravene the New Zealand Consumer Law or other applicable laws.
  5. I agree to and will procure that my Child obeys and accepts the Event rules and any other instructions issued by the Promoter at any time and acknowledge that my Child must satisfy any eligibility criteria determined by the Promoter in relation to the Event.
  6. In participating in the Event, I agree not to and procure that my Child does not do anything which may adversely affect, prejudice or bring into disrepute the reputation of the Promote or the Event.
  7. I acknowledge that my Child’s participation in the Event is at the sole discretion of the Promoter and accept that Promoter may cancel or postpone the Event.
  8. My Child’s registration is not transferable to any other person. I accept that if my Child’s entry form and payment is not received by the Promoter by the relevant and stated online registration closing date for the Event, my Child may not be able to participate in any of the events in the Event. If the Promoter chooses to accept late entries for any reason, the Late Registration Price as stated on the entry form will apply.
  9. If the event is cancelled by the Promoter for any reason, I understand that I will not be refunded If I have opted and paid to have my TRY CHALLENGE t-shirt & medal pack couriered to me, however, If my TRY CHALLENGE t-shirt & medal pack has not already been packed for then I will be entitled to a full refund.
  10. I acknowledge that if I wish to withdraw from the Event, I must inform the Sanitarium Weet-Bix Kids TRY CHALLENGE Customer Services Team via email on TRYathlon@sanitarium.co.nz.
  11. a) I acknowledge and agree that if I or my Child wish to cancel their already completed registration for the Event, after the relevant stated online registration closing date, for any reason whatsoever, then no part of the entry fee paid for my Child will be refunded.
  12. While the Promoter will use all reasonable efforts to ensure the Event is conducted as advertised, I acknowledge that by reason of circumstances beyond the control of the event organisers, it may become necessary or desirable to change the form of the event and if that occurs, I consent to the changes and I agree that each and every one of the conditions set out herein shall apply to that changed event.
  13. I acknowledge and agree that as part of the registration process to provide my email, address, and telephone number.
  14. I acknowledge that my personal information and my Child’s personal information is collected and used by the Promoter for the purposes of registering my Child for, conducting and improving the Event including, providing any merchandise which I have purchased from the Promoter and such other purposes as set out in this clause and in Sanitarium’s privacy policy (available at https://TRY.co.nz/privacy-policy/). Sanitarium may disclose my personal information and my Child’s personal information to third parties who assist Sanitarium to carry out the above purposes such as Register Now Pty Ltd (Register Now). If the personal information is not provided then my Child may not participate in the Event.
  15. I consent to (unless I otherwise advise the Promoter otherwise):
  • the recording of my and my Child’s likeness and/or voice by any means including but not limited to audio and visual recordings by television cameras and photographers engaged by the Promoter and including those photographs and/or videos shared by me or my Child on the Event Facebook page and including (together Images);

(b)   the Promoter collecting and using my Child’s personal details including first name, and also use of the Images by the Promoter or their commercial partners  in accordance with these terms and conditions and the Promoter’s privacy policy (available at https://tryathlon.co.nz/privacy-policy/), before, during or after the Event, for promotional, marketing, broadcasting, reporting or surveying purposes in any media worldwide, including but not limited to, for the purpose of promoting the Promoter’s current and future events held in Australia and New Zealand without compensation to me or any person (including, recording my Child’s participation in the Event and using the Images at the venue and on vision screens); and

(c) from time to time the Promoter may also contact me to provide me with information about other products and services offered by the Promoter, or other service providers who have a relationship with the Promoter, that the Promoter considers may be of interest to my Child or me.  When Sanitarium contacts me, it may be via mail, phone, email and/or SMS.

  1. I consent to:

(c) the use of the Images for commercial exploitation and other promotional or public relations purposes, throughout the world of the Images by any means (including but not limited to broadcast, telecast and print) by Sanitarium or their commercial partners without compensation to me or any other person (including, recording my Child’s participation in the Event and using the Images at the venue and on vision screens).

  1. I understand that to opt out of direct marketing from the Promoter, or to advise the Promoter that I do not consent to the Promoter using by Child’s personal details, images and photographs in the manner described in paragraphs (a) and (b) of this clause, I need to contact the Promoter on +64 9 625 0700, by email TRY@sanitairum.co.nz or post to Private Bag 9212, Victoria Street Wets, Auckland 1142, New Zealand.
  2. I acknowledge that my personal information and my Child’s personal information is collected and used by Register Now for the sole purposes of processing the registration of my Child for the Event (including fees payable by me in relation to such registration), the purchase of any merchandise sold by the Promoter. Register Now may disclose my personal information and my Child’s personal information to School Group coordinator representing your Child’s school to facilitate the registration process of the students of the registered and the Promoter approved School Group. I acknowledge that Register Now may disclose my personal information and my Child’s personal information to third parties who assist Register Now to carry out the above purposes including to the Promoter and School Group coordinators. If the personal information is not provided then my Child may not participate in the Event. Register Now’s Privacy Policy (available at https://registernow.io/privacy ) contains further information about how I may access and/or correct the personal information held about me and my Child as required by law, as well as information about making a complaint about the treatment of personal information and how Register Now will deal with such a complaint.  Register Now’s address and contact details are: 8 Prince Patrick Street Richmond // Victoria // Australia 3121. 26.WEEKLY PRIZE DRAW

To enter into the Weekly Prize draw, individuals must:

  1. Take video and or/photos of their child participating in TRY CHALLENGE.  Individuals submitting videos and/or photos of a child that is not their own must have permission of the child’s parent or guardian to enter them in the Event, and for the video and/or photos to be used in accordance with these Terms and Conditions; and
  2. Post your video and/or photos on your own Facebook or Instagram account; and
  3. Nominate 3 friends who should complete their very own TRY CHALLENGE by tagging them in your post; and
  4. Tag Sanitarium Weet-Bix Kids TRYathlon New Zealand Facebook page @tryathlon or our Instagram @kiwikidstry in your post; and
  5. If you would like an extra entry, join our Sanitarium Weet-Bix Kids TRY CHALLENGE Facebook group.

Any uploaded files must be submitted in accordance with the relevant platform’s requirements.

Incomplete or indecipherable entries will be deemed invalid.

If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its  sole discretion, to determine the identity of the entrant.

If there are issues with uploading the videos/photos or you don’t have social media, users can send their entry to tryathlon@sanitarium.co.nz or contact the Promoter via Sanitarium Weet-Bix Kids TRYathlonFacebook (https://www.facebook.com/tryathlon) and arrange for an alternative entry method.

Winner determination:

The Promoter will at its discretion select its top TRY CHALLENGE Video and/or photo post, based on creative merit, by a panel of judges weekly (excluding Christmas/New Year period) for thirty (30) weeks at 3:00PM NZST at Sanitarium Health Food Company of 124 Pah Road, Royal Oak, Auckland on the following dates:

The weekly winners will be notified in writing within two (2) business days. Each weekly winner will receive a TRY CHALLENGE Prize Pack containing:

– 1 x 3 pack of Up & Go Vanilla (no added sugar), 1 x 3 pack of Up & Go Chocolate (no added sugar), 1 x box of Weet-Bix, 1 x box of Weet-Bix Coconut & Cranberry , 1 x box of Cust Crisp Blueberry & Maple , 1 x jar of Marmite , 1 x jar of Peanut Butter AND;

–  Weet-Bix Kids TRYathlon Merchandise includes a towel, drink bottle, sunglasses, rugby ball, basketball, bike bell.

27. The Promoter’s decision is final, and no correspondence will be entered into.

28. If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

29. Subject to the unclaimed prize draw clause, if for any reason a winner does not take or claim a prize (or an element of a prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

30. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

  6. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
  7. This promotion will run from 10am Wednesday 6th April 2022 and ends 10am Thursday 30th June 2022 (Promotional Period).
  8. To enter, individuals must, during the Promotional Period:
    1. Competition 1: Comment on the Facebook competition post.
    2. Competition 2: Tag Sanitarium Weet-Bix Kids TRYathlon™ New Zealand Facebook or Instagram @kiwikidstry in your photo.
  9. Two winners will be drawn for each competition on 30 th April, 30 th May and 30 th June. Competition Prize consists of Toyota Kiwi Guardians merchandise (hat, t-shirt and jumper) and Competition 2 Prize consists of both Toyota Kiwi Guardians (hat, t-shirt and jumper) and Weet-Bix Kids TRYathlon (drink bottle, towel and Weet-Bix Breakfast Cereal) merchandise.
  10. The draws will take place at 1pm on 30 th April, 30 th May and 30 th June. Sanitarium’s decision is final and no correspondence will be entered into in relation there to. Prizes cannot be transferred, exchanged or redeemed for cash.
  11. Without limiting clause26, entrants acknowledge and agree that all Photograph submitted by entrants and accepted by Sanitarium including any winning Photographs may be published on the Promoter’s social media including the Promoter's Facebook and Instagram accounts and may also be published in or on other forms of promotional and marketing material, including in marketing materials for subsequent UP&GO promotions.
  12. Any uploaded files must be submitted in accordance with the relevant platform’s requirements. Photographs must be in jpeg, gif or png format and less than 5MB in size.
  13. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of this promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. Winners (or if a Winner is under 18 years of age their parent or guardian on their behalf) must upon request supply suitable identification at the time that the Promoter delivers the prize.
  14. Incomplete or indecipherable entries will be deemed invalid.
  15. Multiple entries are permitted per person, however each entry must be substantially unique, submitted separately and in accordance with the entry requirements set out in clause 6 and these Terms and Conditions.
  16. If there is a dispute concerning the conduct of this promotion (including as to the identity of an entrant or a child in a Photograph) or in respect to claiming a prize, the Promoter will consider the entrant’s grievances however reserves the right to resolve the dispute in the manner it determines most appropriate, acting reasonably.
  17. Winners will be announced on a relevant Facebook post, and each winner will be asked to privately message Sanitarium Weet-Bix Kids TRYathlon™ New Zealand via Facebook™ with his/her contact details. Winner’s must message within 5 days, or the prize may be forfeited and rewarded to a new winner.
  18. Sanitarium is not responsible for the transmission or receipt of any incorrect information associated with entries, either caused by user error or any equipment or programming malfunction.
  19. Sanitarium reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend any competition at any time.
  20. Sanitarium reserves the right to use any entrant’s name, voice, image and likeness for advertising and publicity purposes in any media in perpetuity without additional compensation, unless otherwise advised by the entrant.
  21. All comments, posts and competition entries become the property of Sanitarium. Where personal information is collected and stored by Sanitarium it will be done so in accordance with the Privacy Act 2020. You have the right to access your personal information and request correction of any errors in it pursuant to the Privacy Act 2020. By entering a competition, each entrant is taken to consent to Sanitarium using the entrant’s personal information to administer the competition (where applicable) and disclosing the entrant’s personal information to organisations that assist Sanitarium with administering the competition.
  22. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  23. Entrants agree that they are fully responsible for any materials they submit in relation to this promotion including but not limited to comments, recordings and images (Content). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that:
    1.  they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
    2. their Content shall not contain viruses or cause injury or harm to any person or entity;
    3. they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
    4. the Content is the original artistic or literary work of the entrant that does not infringe the rights of any third party;
    5. they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
    6. they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others computer or communication systems.
  24. Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any
    breach of the above terms.
  25. As a condition of entering this promotion, each entrant licenses and grants the Promoter, its
    affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-
    licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include
    Content) for any purpose, including but not limited to future promotional, marketing or publicity
    purposes, in any media, without compensation, restriction on use, attribution or liability.
  26. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event
    they are a Winner (including photograph, film and/or recording of the same) in any media for an
    unlimited period without remuneration for the purpose of promoting this promotion (including any
    outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  27. If this promotion is interfered with in any way or is not capable of being conducted as reasonably
    anticipated due to any reason beyond the reasonable control of the Promoter, including but not
    limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right,
    in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b)
    subject to any written directions from a regulatory authority, to modify, suspend, terminate or
    cancel this promotion, as appropriate.
  28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude
    or modify the statutory consumer guarantees.
  29. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,
    the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:

    1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
    2. any theft, unauthorised access or third party interference;
    3. any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    4. any variation in prize value to that stated in these Terms and Conditions;
    5. any tax liability incurred by a winner or entrant; or
    6. use of a prize.
  30. Any cost associated with accessing Instagram or Facebook is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  31. This promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram or Facebook. Entrants understand that they are providing their information to the Promoter and not to Instagram or Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Instagram or Facebook. Instagram/Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
  32. Where a Promotion is conducted across social media: (a) Entrants’ conduct must comply with the rules of that social media platform. (b) Promotions are in no way sponsored, endorsed or administered by, or associated with Facebook, Twitter, Instagram or TikTok. These social media platforms are in no way responsible for any aspect of Promotions.
  33. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to New Zealand regulatory authorities, and may also use and handle personal information as set out in its privacy policy. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
  7. This promotion will run from 10am Tuesday 3rd May 2022 and ends 10am Wednesday 18th May 2022 (Promotional Period).
  8. To enter, individuals must, during the Promotional Period:

– Facebook: Add video to comments section on the Facebook competition post.

– Instagram: Tag @kiwikidstry and @evocyclesnz in your video post.

  1. The Promoter will select 8 videos and give the public the chance to vote on Sanitarium’s Instagram and Facebook accounts from 10am Monday 23rd May 2022 until midnight Sunday 29th May 2022.
  2. The Prize:

– the prize is an Evo Rocker 24 Kids Bike from Evo Cycles valued at NZD$429.90 (Prize). There are three (3) Prizes to be won. The 3 videos that receive the most likes across both Facebook and Instagram accounts will win 1 Prize each.

  1. The winners will be announced at 10am Monday 30th May 2022. The Promoter’s decision is final and no correspondence will be entered into in relation there to. Prizes cannot be transferred, exchanged or redeemed for cash.
  2. Without limiting clause 27, entrants acknowledge and agree that all Photograph submitted by entrants and accepted by the Promoter including any winning Photographs may be published on the Promoter’s social media including the Promoter’s Facebook and Instagram accounts and may also be published in or on other forms of promotional and marketing material, including in marketing materials for subsequent Weet-Bix and/or Weet-Bix Kids TRYathlon™ promotions.
  3. Any uploaded files must be submitted in accordance with the relevant platform’s requirements.
  4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of this promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. Winners (or if a Winner is under 18 years of age their parent or guardian on their behalf) must upon request supply suitable identification at the time that the Promoter delivers the prize.
  5. Incomplete or indecipherable entries will be deemed invalid.
  6. Multiple entries are permitted per person, however each entry must be substantially unique, submitted separately and in accordance with the entry requirements set out in clause 6 and these Terms and Conditions.
  7. If there is a dispute concerning the conduct of this promotion (including as to the identity of an entrant or a child in a Photograph) or in respect to claiming a prize, the Promoter will consider the entrant’s grievances however reserves the right to resolve the dispute in the manner it determines most appropriate, acting reasonably.
  8. Winners will be announced on a relevant Facebook post, and each winner will be asked to privately message Sanitarium Weet-Bix Kids TRYathlon™ New Zealand via Facebook™ with his/her contact details. Winner’s must message within 5 days, or the prize may be forfeited and rewarded to a new winner.
  1. Sanitarium is not responsible for the transmission or receipt of any incorrect information associated with entries, either caused by user error or any equipment or programming malfunction.
  2. Sanitarium reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend any competition at any time.
  3. Sanitarium reserves the right to use any entrant’s name, voice, image and likeness for advertising and publicity purposes in any media in perpetuity without additional compensation, unless otherwise advised by the entrant.
  4. All comments, posts and competition entries become the property of Sanitarium. Where personal information is collected and stored by Sanitarium it will be done so in accordance with the Privacy Act 2020. You have the right to access your personal information and request correction of any errors in it pursuant to the Privacy Act 2020. By entering a competition, each entrant is taken to consent to Sanitarium using the entrant’s personal information to administer the competition (where applicable) and disclosing the entrant’s personal information to organisations that assist Sanitarium with administering the competition.
  5. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  6. Entrants agree that they are fully responsible for any materials they submit in relation to this promotion including but not limited to comments, recordings and images (Content). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that:
  • they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
  • their Content shall not contain viruses or cause injury or harm to any person or entity;
  • they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
  • the Content is the original artistic or literary work of the entrant that does not infringe the rights of any third party;
  • they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
  • they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.
  1. Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.
  2. As a condition of entering this promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
  3. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  4. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel this promotion, as appropriate.
  5. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:

(a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);

(b) any theft, unauthorised access or third party interference;

(c) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

(d) any variation in prize value to that stated in these Terms and Conditions;

(e) any tax liability incurred by a winner or entrant; or

(f) use of a prize.

  1. Any cost associated with accessing Instagram or Facebook is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

Entrants understand that they are providing their information to the Promoter and not to Instagram or Facebook.
